End User License Agreement

This End User License Agreement ("Agreement") is between you and Moxxio ("Company," "we," or "us") and governs your use of the Moxxio mobile application ("App"), available on iOS and Android platforms. By downloading, installing, or using the App, you agree to be bound by this Agreement.

1. License Grant

Subject to your compliance with this Agreement, Moxxio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a device that you own or control, as permitted by the applicable App Store or Google Play Store rules.

2. Subscriptions and In-App Purchases

The App offers subscription-based features and in-app purchases. All subscription billing and payment processing is handled by RevenueCat, a third-party subscription management platform, in conjunction with Apple's App Store and Google Play Store.

2.1 Subscription Plans

• Subscription plans and pricing are displayed in the App and may vary by region.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions through your Apple App Store or Google Play Store account settings.

2.2 Payment Processing

• All payments are processed through Apple's App Store (iOS) or Google Play Store (Android).
• RevenueCat manages subscription verification, status, and cross-platform synchronization.
• We do not store your payment information. All billing is handled by Apple or Google.
• Subscription receipts and transaction data are processed by RevenueCat in accordance with their privacy policy.

2.3 Free Trials

• If offered, free trials allow you to try premium features before being charged.
• You may cancel during the trial period without charge through your App Store or Google Play account settings.
• If not cancelled, the trial will automatically convert to a paid subscription at the end of the trial period.

2.4 Refunds

• All refund requests must be made through Apple App Store or Google Play Store, as applicable.
• Refund policies are governed by Apple's and Google's respective terms and conditions.
• We cannot process refunds directly but will assist with refund requests where appropriate.

3. Platform Terms

3.1 Apple App Store

If you download the App from Apple's App Store, you acknowledge and agree that:

• This Agreement is between you and Moxxio only, not with Apple.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims by you or third parties relating to the App.
• Apple is a third-party beneficiary of this Agreement and may enforce it.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted party list.

3.2 Google Play Store

If you download the App from Google Play Store, you agree to Google's Terms of Service and acknowledge that:

• This Agreement is between you and Moxxio, not with Google.
• Google is not responsible for the App or its content.
• Google has no obligation or liability to you with respect to the App or this Agreement.

4. Privacy and Data

Your use of the App is also governed by our Privacy Policy. We are committed to protecting your privacy:

• Data Storage: Your nutrition data, meal logs, and food images are securely stored in our database to enable app functionality and sync across your devices.
• Subscription Data: RevenueCat collects minimal data necessary to manage your subscription (such as user ID, subscription status, and transaction receipts).
• Account Deletion: You can request deletion of your account and all associated data at any time by contacting support@moxxio.com. We will permanently remove your data within 30 days of your request.

5. User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws and regulations.
• Not reverse engineer, decompile, or disassemble the App.
• Not use the App for any unlawful or prohibited purpose.
• Not attempt to gain unauthorized access to any portion of the App or its systems.
• Not distribute, sell, lease, rent, or sublicense the App.
• Use the App for your personal, non-commercial use only.

6. Intellectual Property

The App and all rights therein are and shall remain the property of Moxxio. This includes all software, designs, graphics, text, AI models, and other content. Nothing in this Agreement grants you any right to use Moxxio's trademarks, logos, domain names, or other brand features.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Important: The App provides nutritional information for general informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or diet.

We do not warrant that the nutritional information provided is accurate, complete, or up-to-date. AI-powered food recognition may not always be accurate, and you should verify nutritional information when accuracy is critical.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOXXIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App;
• Any unauthorized access to or use of your device or data;
• Any interruption or cessation of the App;
• Any errors or omissions in nutritional information;
• Any health or dietary decisions made based on App data.

9. Termination

This Agreement is effective until terminated. We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination:

• Your license to use the App will immediately cease.
• You must delete the App from all devices.
• Active subscriptions will remain governed by the App Store or Google Play Store refund policies.

10. Changes to Terms

We reserve the right to modify this Agreement at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the modified Agreement.

11. Export Compliance

You may not use or export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from this Agreement shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
